Frequently
Asked
Questions
Straightforward answers to the questions we hear most often from employers navigating the Skilled Worker visa UK.
What is the Skilled Worker route?
What is a Skilled Worker visa?
A Skilled Worker visa is the permission granted to an individual to enter or remain in the UK for a sponsored role. The applicant needs a valid Certificate of Sponsorship, must meet salary and skill level requirements, and must demonstrate English language proficiency. The visa can be granted for up to five years and can lead to settlement after five years of continuous residence.Â
Does my business need one?
If you intend to employ a non-British or non-Irish citizen who requires a visa to work, you must hold a valid license. This applies across all sectors and business sizes. Â
What are our legal responsibilities?
Holding a license is a “privilege, not a right.” You must maintain strict records, perform robust right-to-work checks, and report certain employee changes (like a change in job title or salary) via the Sponsorship Management System (SMS). Â
Note: Failure to comply can lead to your license being suspended or revoked, which would end the right of all your sponsored staff to remain in the UK. Â
What is the difference between a Defined and Undefined CoS?
The type of Certificate of Sponsorship (CoS) you need depends entirely on where your candidate is located when they apply. A Defined CoS is required for candidates applying from outside the UK and must be requested from the Home Office on a case-by-case basis. An Undefined CoS is used for candidates already in the UK such as those switching from a student visa and is drawn from your company’s pre-approved annual allocation. Â
Who is eligible to apply?
To qualify, you must have a confirmed job offer from a licensed UK employer. The role must meet the RQF Level 6 (degree-level) skill requirement and satisfy the new 2026 salary thresholds (typically £41,700 per year or the “going rate” for the role). Â
What are the 2026 English Language requirements?
As of January 8, 2026, the English language standard for new applicants has been raised to CEFR Level B2 (Upper-Intermediate). You can prove this through an approved test, a degree taught in English, or if you are a national of a majority English-speaking country. Â
What is a Certificate of Sponsorship (CoS)?
A CoS is not a physical paper document; it is a unique electronic reference number generated by your employer. It proves to the Home Office that the job you’ve been offered is genuine and meets all the legal requirements for sponsorship. You cannot apply for your visa without this number. Â
Can my family join me?
Yes. This visa allows your partner and dependent children to apply for Dependant Visas. They will have the right to live, work, and study in the UK for the same duration as your visa.  Â
